By accessing and using LivingSoulsPK.com (“the Website,” “the Platform,” “our Site,” “we,” “us,” “our”), you agree to be bound by these Terms and Conditions (“Terms”). These Terms constitute a legally binding agreement between you and LivingSoulsPK. If you do not agree to all of these Terms, you must not use this Website.

2. Definitions

  • “User” refers to any individual or entity accessing the Website.
  • “Seller” refers to a User who lists animals for sale on the Platform.
  • “Buyer” refers to a User who browses or purchases animals on the Platform.
  • “Listing” refers to the advertisement created by a Seller for an animal available for sale.
  • “Content” refers to any text, images, photographs, descriptions, or other material posted on the Platform.
  • “Transaction” refers to the process initiated between a Buyer and Seller for the potential sale of an animal.

3. Eligibility and Account Registration

  1. You must be at least 18 years of age to use this Website.
  2. You must provide accurate, current, and complete information during the registration process.
  3. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
  4. You agree to notify us immediately of any unauthorized use of your account.
  5. We reserve the right to suspend or terminate your account if any information provided is inaccurate or misleading.

4. Nature of the Platform

  1. LivingSoulsPK.com is a marketplace platform that facilitates connections between Buyers and Sellers of legally tradable animals.
  2. We are not a party to any transaction. We do not own, sell, resell, or take possession of any animals listed. We are not involved in the actual transaction between Buyers and Sellers.
  3. We are not responsible for the quality, safety, health, legality, or delivery of any animal listed. The responsibility for the accuracy of a Listing and the fulfillment of a Transaction lies solely with the Seller.
  4. The Platform is for personal or agricultural use in accordance with Pakistani law. Commercial breeding or trade operations must comply with all applicable local, provincial, and national regulations.

5. User Responsibilities and Acceptable Use

As a User, you agree:

  1. To use the Platform only for lawful purposes related to the buying and selling of legally tradable animals in Pakistan.
  2. To comply with all applicable local, provincial, and national laws, including but not limited to animal welfare, trade, and transportation regulations.
  3. To only list animals that are legally permitted for sale in your jurisdiction within Pakistan. It is your sole responsibility to verify legality.
  4. To provide truthful, accurate, and complete information in all Listings and communications.
  5. To maintain the health and welfare of any animal in your care to a reasonable standard until a Transaction is completed.
  6. To not engage in fraud, misrepresentation, or deceptive practices.
  7. To not upload harmful code or attempt to disrupt the Platform’s functionality.
  8. To not harass, abuse, or harm another User.
  9. To not infringe upon the intellectual property rights of others.

6. Seller-Specific Obligations

By creating a Listing, you, as a Seller, represent and warrant that:

  1. You have the legal right to sell the animal described.
  2. All information in the Listing (including breed, age, health status, vaccination records, and temperament) is accurate to the best of your knowledge.
  3. You possess any required documentation (e.g., ownership proof, health certificates, vaccination records) and will provide them to a serious Buyer upon reasonable request.
  4. You will communicate transparently with potential Buyers regarding the animal’s condition and history.
  5. You are responsible for determining the final sale price.

7. Buyer-Specific Obligations

As a Buyer, you agree:

  1. To exercise due diligence before engaging in a Transaction. You are solely responsible for verifying the accuracy of a Listing, the health of an animal, and the reputation of the Seller.
  2. To comply with any applicable laws regarding animal ownership, transportation, and import/export within Pakistan.
  3. That you are financially responsible for any Transaction you initiate.

8. Transactions and Disputes

  1. Transaction Terms: All terms of a sale (including final price, delivery/collection method, payment terms, and health guarantees) are to be negotiated and agreed upon directly between the Buyer and Seller. We recommend these terms be confirmed in writing.
  2. Platform Role: LivingSoulsPK is not involved in payment processing, delivery, or dispute resolution between Users. We do not provide escrow services.
  3. User Responsibility: Users transact with each other at their own risk. We encourage Users to inspect an animal in person and obtain all necessary documentation before finalizing payment.
  4. Disputes: Any disputes arising from a Transaction must be resolved directly between the Buyer and Seller. LivingSoulsPK has no obligation to mediate or resolve such disputes, though we may, at our sole discretion, suspend the accounts of Users involved in a serious dispute.

9. Content and Intellectual Property

  1. Your Content: You retain ownership of the Content you submit. By posting Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute that Content on the Platform for the purpose of operating and promoting the service.
  2. Our Content: All content on the Website (except User Content), including text, graphics, logos, and software, is our property or the property of our licensors and is protected by copyright and intellectual property laws. You may not use it without our express written permission.

10. Prohibited Items and Activities

You may not use the Platform to list, buy, or facilitate the trade of:

  1. Animals that are endangered, protected, or illegal to trade under Pakistani law.
  2. Animals that are sick or injured without full disclosure.
  3. Animals for the purpose of illegal fighting, baiting, or other cruel activities.
  4. Any item or service unrelated to the trade of legally tradable animals.

11. Disclaimer of Warranties and Limitation of Liability

  1. “As Is” Basis: The Platform and all services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied.
  2. No Endorsement: We do not endorse any User or Listing. References to “verified” status relate only to identity confirmation, not to the quality, health, or legality of an animal.
  3. Limitation of Liability: To the fullest extent permitted by law, LivingSoulsPK, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
    • Your use or inability to use the Platform.
    • Any conduct or content of any third party (including other Users).
    • Any unauthorized access, use, or alteration of your transmissions or content.
    • Any transactions or interactions between Users.

12. Indemnification

You agree to defend, indemnify, and hold harmless LivingSoulsPK and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or relating to:

  1. Your violation of these Terms.
  2. Your use of the Platform.
  3. Your Content or any Listing you create.
  4. Your interaction with any other User, including any Transaction.

13. Termination and Suspension

We may, at our sole discretion, suspend or terminate your account and access to the Platform at any time, without notice, for conduct that we believe violates these Terms, is harmful to other Users, or is harmful to our interests, including for:

  1. Violating applicable laws.
  2. Creating fraudulent or misleading Listings.
  3. Harassing other Users.
  4. Infringing intellectual property rights.

14. Modifications to the Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the “Effective Date” and, where feasible, posting a notice on the Website. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.

15. Governing Law and Dispute Resolution

  1. These Terms shall be governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions.
  2. Any dispute arising from or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts located in [City, e.g., Lahore], Pakistan.

16. Severability
